Please read these Terms & Conditions carefully before purchasing a membership, pass or class credits. By joining Infinity Fitness, completing a health questionnaire, or using our facilities, you agree to be bound by these terms.

These terms are between you (the “Member”) and Infinity Fitness Ltd, Exeter Road, Dawlish, Devon, EX7 0LX (“Infinity Fitness”, “we”, “us”, “our”). You can contact us at infinity.membership@infinityfitnessdawlish.com or on 07386 354422.

1. About these terms

1.1 These terms apply to all memberships, day and week passes, class credits and use of our facilities.

1.2 We may update these terms from time to time (for example, to reflect changes in the law or how we operate). If we make a significant change, we will give you reasonable advance notice by email or a notice at the gym. The version in force is always the one published on our website.

1.3 Nothing in these terms affects your legal rights as a consumer under the Consumer Rights Act 2015 or other applicable UK law.

2. Membership types

2.1 We offer the following memberships and products (current prices are shown on our Plans & Pricing page and may change in line with section 8):

  • All Inclusive Membership — unlimited access to the gym, classes and recovery suite, including 24/7 access once set up at reception.

  • Off Peak Membership — gym access between 09:00 and 15:30.

  • Teen Membership — for members aged 13–16, during staffed hours only (see section 3).

  • Day Pass / Week Pass — short-term access during staffed hours only.

  • Class Credits — pre-paid credits redeemable against bookable classes.

2.2 The benefits included with each membership are those listed for that plan at the time of purchase. Class timetables, facilities and equipment may change from time to time.

3. Eligibility and members under 18

3.1 You must be aged 16 or over to hold a standard adult membership or to purchase a Day or Week Pass, unless accompanied by an adult.

3.2 Teen Members (aged 13–16): Teen Membership is available only with the consent of a parent or legal guardian, who must complete the relevant consent and health information at sign-up. Teen Members may use the gym during staffed hours only and must follow all instructions from staff. The parent or guardian accepts responsibility for the Teen Member’s compliance with these terms.

3.3 We may ask for proof of age and reserve the right to refuse access where age or consent cannot be verified.

4. Joining and payment

4.1 There is no joining or admin fee. You pay only the price of your chosen membership, pass or credits.

4.2 Monthly memberships are paid monthly in advance by recurring card payment through our online payment system. Your first payment is taken at sign-up and subsequent payments on or around the same date each month.

4.3 Day Passes, Week Passes and Class Credits are paid for in full at the time of purchase.

4.4 If a payment fails or is not made when due, we may suspend your access until the outstanding amount is paid. We may ask you to update your payment details and re-present the payment.

4.5 You are responsible for keeping your payment and contact details up to date.

5. Your 14-day cooling-off period

5.1 If you purchase a membership, pass or credits online or otherwise at a distance (i.e. not in person at the gym), you have the right to cancel within 14 days of purchase for a full refund, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

5.2 To exercise this right, tell us clearly within the 14 days (by email to infinity.membership@infinityfitnessdawlish.com or in person at reception).

5.3 If you ask to start using the facilities during the 14-day period and then cancel, we may charge you a proportionate amount for the period you had access before cancelling.

6. Cancelling your membership

6.1 Monthly memberships are rolling monthly agreements with no minimum term. You may cancel at any time by giving 30 days’ notice.

6.2 To cancel, contact us by email at infinity.membership@infinityfitnessdawlish.com, in person at reception, or through the same channel you used to join. Your membership and payments will continue for 30 days from the date we receive your notice, after which they will stop.

6.3 You remain entitled to use the facilities included in your membership up to the end of the notice period.

6.4 Day Passes, Week Passes and Class Credits cannot be cancelled once purchased except under your 14-day cooling-off right (section 5) or where required by law. Class Credits are valid for the period stated at purchase and expire after that date.

7. Cancelling due to injury, illness or change of circumstances

7.1 In line with Competition and Markets Authority guidance, we will allow you to cancel your membership (and, where appropriate, waive the notice period) if:

  • you suffer an illness or injury, confirmed by a medical professional, that prevents you from using the gym for an extended period; or

  • your circumstances change significantly through no fault of your own (for example, redundancy or relocation away from the area) so that you can no longer reasonably use or afford the membership.

7.2 We may ask for reasonable evidence to support your request. We may also offer to freeze your membership as an alternative (see section 8).

8. Freezing, and changes to prices or facilities

8.1 Freezing: You may ask to freeze your membership for a minimum of one month and up to a maximum of three months in any 12-month period — for example due to illness, injury or travel. A reduced holding fee of £5 per month applies while your membership is frozen, and freeze requests must be made in writing before your next payment date.

8.2 Price changes: We may change membership prices from time to time. We will give you at least 30 days’ written notice of any increase to your monthly fee. If you do not wish to accept the increase, you may cancel in accordance with section 6 before it takes effect.

8.3 Facilities: We may occasionally need to close, alter or remove facilities, classes or equipment (for example, for maintenance, refurbishment or safety). Where a change is significant and ongoing, we will act fairly and, if appropriate, offer a suitable alternative or the right to cancel.

9. Access, security and 24/7 use

9.1 All Inclusive Members may access the gym 24/7 once access control has been set up at reception during staffed hours.

9.2 Your access fob is personal to you and must not be shared. Lost or stolen fobs must be reported to reception immediately (a replacement fee may apply). You must not allow anyone else to enter using your fob, or hold doors open for people you do not know (“tailgating”), as this affects the safety and security of all members.

9.3 During unstaffed hours you use the gym at your own risk. You should familiarise yourself with the location of emergency equipment, alarms and exits, and follow the safety guidance provided.

9.4 We may refuse entry, withdraw access or terminate membership where access rules are breached.

10. Health, fitness and your responsibility

10.1 You must complete a health questionnaire (PAR-Q) before using the gym and tell us about any medical condition, injury or other factor that may affect your ability to exercise safely.

10.2 You should not exercise beyond your own abilities. If you know or have reason to believe your health is not suitable for exercise, you must get medical advice before using the facilities.

10.3 You are responsible for exercising safely, using equipment correctly and following instructions and signage. If you are unsure how to use any equipment, ask a member of staff.

10.4 If you feel unwell at any time while exercising, you must stop and seek assistance.

11. Recovery suite — sauna and ice bath

11.1 Use of the sauna and ice bath is at your own risk and is not suitable for everyone. Do not use them if you are pregnant, have a heart condition, high or low blood pressure, or any other condition that may be affected by heat or cold exposure, or if you are under the influence of alcohol or drugs — seek medical advice first if in any doubt.

11.2 You must follow all posted safety rules, recommended time limits and instructions from staff when using the recovery suite.

11.3 Members must be 18 or over to use the sauna and ice bath unless we agree otherwise in writing.

12. Rules of conduct

12.1 You must behave in a way that is respectful and safe towards other members, staff and visitors. We operate a zero-tolerance approach to abusive, threatening, discriminatory or intimidating behaviour.

12.2 You must wear appropriate clothing and footwear, wipe down equipment after use, return weights and equipment to their proper place, and respect others’ use of the facilities.

12.3 Photography or filming of other members without their consent is not permitted.

12.4 We may refuse admission, suspend or terminate the membership of any member who seriously or repeatedly breaches these rules, without refund.

13. Classes and bookings

13.1 Classes are subject to availability and must be booked in advance through our booking system or app.

13.2 If you cannot attend a booked class, please cancel at least 12 hours before it starts so the space can be offered to another member. If you cancel later than this or do not attend, the class credit used to book will be forfeited. Members who repeatedly miss booked classes without cancelling may have their booking privileges reviewed.

13.3 We may change, cancel or substitute classes, timetables or instructors. Where we cancel a class you have booked, we will refund the credit or offer an alternative.

14. Our liability

14.1 We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud.

14.2 Subject to clause 14.1, we are not responsible for loss or damage that is not foreseeable, or for loss or damage to your personal property brought onto the premises, except where caused by our negligence. Please keep valuables secure and use lockers where provided.

14.3 We are not liable for any failure or delay in providing facilities caused by events outside our reasonable control.

15. Suspension or termination by us

15.1 We may suspend or terminate your membership (with a refund of any period paid for but not used, where fair) if you seriously or repeatedly breach these terms, put the safety of others at risk, or fail to make payment.

15.2 Termination does not affect any rights or payments that have already accrued.

16. Data protection

16.1 We process your personal data (including health information you provide) in accordance with the UK GDPR and the Data Protection Act 2018, and in line with our Privacy Policy, which is available on our website.

16.2 We use your information to manage your membership, keep you safe while exercising, take payments and communicate with you. We will not share it except as described in our Privacy Policy or as required by law.

17. Complaints

17.1 We want you to be happy with your membership. If something is wrong, please speak to a member of staff or email infinity.membership@infinityfitnessdawlish.com and we will do our best to put it right.

18. General

18.1 If any part of these terms is found to be invalid or unenforceable, the remaining terms will continue to apply.

18.2 These terms are governed by the law of England and Wales, and any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
